MEMORANDUM OPINION AND ORDER
PLUNKETT, District Judge.
In this suit, plaintiff Bernard Shaney Willis seeks damages and equitable relief from defendant United States of America, to redress alleged violations of his fourth and fifth amendment rights resulting from a seizure of his car by officers of the Drug Enforcement Administration (the “D.E.A.”) pursuant to 21 U.S.C. § 881(a)(4). Plaintiff attempts to invoke, and to the extent that damages do not exceed $10,000, defendant purports to “concede,” jurisdiction under the Tucker Act, 28 U.S.C. § 1346(a)(2).
