This case is before the Court on the debt- or’s Application to Avoid Transfer of Property and to Set Aside Foreclosure Sale. The issues presently before the Court arise out of the following transactions. On December 15, 1971, James and Lutrella Goo-den purchased the property known as 392 Morgan Place, S. E., Atlanta, Georgia, and executed a promissory note and deed to secure debt which was duly recorded in DeKalb County, Georgia.
