This was an action for damages for injuries alleged to have been sustained when the car in which plaintiff was riding collided with a truck. Judgment was for plaintiff. Defendant appeals.

The action was against the Baxter Chat Company and Vernon White and James White, his brother. The Chat Company was engaged in operating a tailing mill. In operating this mill it had chats, *751tailings and sand hauled from a point about one and one-half miles south of Baxter Springs to its tailing mill west of that city.
