This matter is before the Court on defendant’s motion to dismiss for lack of subject matter jurisdiction pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. Plaintiff Darrell W. Williams brings suit under the Equal Credit Opportunity Act (“ECOA”), 15 U.S.C. §§ 1691 et seq., the Administrative Procedure Act (“APA”), 5 U.S.C. §§ 551 et seq., and the Due Process Clause of the Fifth Amendment.
