Appellants and respondents are the owners of adjoining lands abutting upon Lake Pend d’Oreille in Kootenai County. A dispute arose over conflicting littoral rights claimed by the parties. Respondents brought this action wherein they alleged interference by appellants with the littoral rights and dock facilities claimed by respondents and prayed for an injunction and for both compensatory and exemplary damages.
