This case is before the court on defendant’s motion to dismiss for lack of subject *572matter jurisdiction or, in the alternative, failure to state a claim. Plaintiffs seek compensation for defendant’s physical taking and imposition of a servitude upon plaintiffs’ property through the publication of an aeronautical chart and the issuance of two hazard determinations by the United States acting through the Federal Aviation Administration (FAA or defendant), an administration within the Department of Transportation.
