This is an appeal from an order of the district court vacating a temporary restraining order and denying a motion for the appointment of a receiver. Francis M. Seward, as plaintiff, seeks to recover from William Schrieber, defendant, one-half the sum of $3,390 which was the net proceeds of the amount paid defendant by the Veterans Administration on a written contract covering a wall-cleaning project.
