I. INTRODUCTION
Currently before the Court are two motions: Defendants’ motion for summary judgment in part and to dismiss in part and Plaintiffs motion for a preliminary injunction.
On May 17, 2010, Defendant James W. Houck, in his official capacity as the Judge Advocate General of the Navy (the “Navy JAG”), indefinitely suspended Plaintiff Earle A.
