OPINION AND ORDER
LEVAL, District Judge.
These are actions brought under 42 U.S.C. § 1983 for declaratory, injunctive, and monetary relief. The common claims of these actions are that defendants have violated plaintiffs’ rights under the equal protection clause of the Fourteenth Amendment, 1 and N.Y.Exec.Law § 291(1) 2 by refusing to hire them because of their age. At issue is the constitutionality of N.Y.Civ. Serv.Law § 58(1) 3 and N.Y.
