THIS CAUSE has come before the court for review sua sponte upon the issuance of the Supreme Court’s opinion in Chappell v. Wallace, — U.S. —, 103 S.Ct. 2362, 76 L.Ed.2d 586 (1983), and upon counsel for the plaintiff’s letter to the court and the plaintiff’s response to the previously filed motions to dismiss. In light of all of the foregoing, the court finds it necessary to clarify its prior opinion denying in part the defendants’ motion to dismiss, Stanley v. United States, et al.
