The Court of Appeals has certified' to us the following question: “The Court of Appeals desires the instruction of the Supreme Court as to the following question of law arising *128in the foregoing case: The plaintiff in error was convicted of a capital felony, and presented to the judge of the superior court a bill of exceptions, not specifying whether the writ of error was to be returnable to the Supreme Court or the Court of Appeals.
