Fredrick C. Hamann, appellant and cross-appellee, brought this action to recover damages for breach of contract or, in the alternative, for relief by way of mandamus compelling appellees and cross-appellants to tender him a teacher’s contract for the school year 1970-71.

The issue is whether appellant was entitled to be reinstated to his former teacher’s position after a leave of absence (or sabbatical) under the provisions of the college policy regulations, which were incorporated by reference in Hamann’s contract of employment. The section of…
