This was an action by a former wife of a testator to obtain a construction of his will. Judgment was for plaintiff and only one defendant, an intervenor, appeals.

The action was instituted in the district court of Marion county against E. M; Strong, a testamentary trustee, to obtain an accounting of his trusteeship pertaining to the rents and profits of a particular tract of land involved in this action; to have the trust declared *207lapsed and for a decree declaring title to the land involved to have passed to plaintiff under the residuary…
