A special court-martial composed of a military judge sitting alone, convicted Appellant, pursuant to his plea, of failure to obey an order, in violation of Article 90, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 890 (2000). The adjudged and approved sentence included a bad-conduct discharge, confinement for forty-five days, and forfeiture of $700.00 pay per month for two months.
