On September 15, 2009, Plaintiff Trade Thomas on behalf of herself and those *1081similarly situated filed this action against Taco Bell Corp. (“Taco Bell”), asserting a claim under .the Telephone Consumer Protection Act, 47 U.S.C. § 227(b)( 1)(A)(iii). Her lawsuit arises out of.a text message marketing campaign conducted by the Chicago Area Taco Bell Local Owners Advertising Association (the “Association”).
