Appeal from a judgment of the superior court for Chehalis county, Irwin, J., entered April 30, 1910, upon findings in favor of the defendants, upon appeal from an award of the state board of land commissioners, in a contest over the preference right to purchase tide lands.

On the 16th day of February, 1907, the plat of the Aberdeen tide lands was filed in the office of the commissioner of public lands. On March 23 following, the appellant Ella J. Book filed in the same office an application to purchase all the tide lands involved in this action. On April 13 following, the respondents Thomas filed their application to purchase the same tide' lands. After hearing on the merits, the board of state land commissioners awarded the preference right to purchase to the appellants.
