This case comes before the Court on defendant’s Motion to Dismiss.

On August 2, 2011, plaintiff Hartford Fire Insurance Company (“Hartford”), a Connecticut corporation with its principal place of business in Hartford, Connecticut, filed a complaint in the Court of Federal Claims against the United States, acting specifically through the United States Army Corps of Engineers (“the Corps”). The complaint alleged the Corps wrongfully disbursed funds to Overstreet Electric Co. (“Overstreet”), a contractor for whom Hartford had acted as a Miller Act surety…
