In early 1978 the director of the Montgomery County Department of Family and Children Services (DFCS) announced her intention to retire. The county board of family and children services, pursuant to Code Ann. § 99-504, considered the qualifications of three applicants and recommended to the appellee-commissioner of Human Resources (commissioner) that appellant be appointed to the county directorship.
