This Government contract case comes before the Court on the defendant’s motion for summary judgment under Rule 56 of the Rules of the United States Court of Federal Claims (“RCFC”). The plaintiffs in this action, two foreign electric utilities corporations, each individually entered into uranium enrichment services contracts with the United States Department of Energy (“DOE”) in 1984.
