OPINION

BROTMAN, District Judge:

Presently before the court is the motion of defendant, Anheuser-Busch, Inc. (“ABI”) for partial summary judgment. For the reasons set forth below, defendant’s motion is denied.

I. Factual Background

Born in India, and a United States citizen since 1988, plaintiff Surinder Chandoke (“plaintiff,” or “Chandoke”) alleges that ABI committed racial and national origin discrimination when it rejected his job application.
