James A. Young, a widower, died intestate on February 6, 1940. Thereafter, the plaintiff, George W. Faulkner, filed an amended complaint in the circuit court of Cook county seeking specific performance of an alleged contract between Young and himself, by which the former agreed to devise to him an unencumbered, improved parcel of real estate in Chicago. Benjamin H. Black, administrator of the estate of James A.
