The Plaintiff has appealed from a chancery decree denying its recovery of federal housing subsidy payments which it alleges the Defendant was not entitled to receive.

The Plaintiff-Appellant, Elizabethton Housing and Development Agency, Inc., is a public housing agency as defined in the United States Housing Act of 1937 (PHA). As such, it acts as the agency for the U.S. Department of Housing and Urban Development (HUD) in contracting for and paying subsidy for suitable housing for eligible applicants.
