Plaintiff Robert Lindsey is a retired government employee, formerly with the Immigration and Naturalization Service of the Department of Justice. In February 1974 he was absent from his job for 76 working hours as a consequence of knee surgery. He was entitled to compensation for that time by charging the hours against his approximately 2,000 hours of accumulated sick leave.
