MEMORANDUM OPINION AND ORDER

JOSEPH F. ANDERSON, Jr., District Judge.

This matter is currently before the court on Plaintiffs’ and Defendant’s cross-motions for summary judgment. The court heard argument on these motions on September 28, 1994 and, at the conclusion of the hearing, requested the parties to submit additional memoranda addressing an issue raised by the court, but not addressed in the briefs of either party.
