MEMORANDUM OPINION AND ORDER
CONBOY, District Judge:
Plaintiff Arthur Miller, a black man, brings this action pursuant to 42 U.S.C. § 1981 and 42 U.S.C. § 2000e et seq. (Title VII). Plaintiff alleges that he was discriminated against on the basis of race while he worked at the defendant SwissRe Holding (North American) Inc. (“SwissRe”), namely that he was harassed and that they failed to promote him. He also claims that he was terminated in retaliation for filing a complaint with the EEOC.
