AMUNDSON, Circuit Judge.

This appeal stems from an intermediate order that denied Carol and Darrell Kaar-up’s motion to compel discovery. We affirm in part, reverse in part and remand.

In 1979 Carol Kaarup purchased a home that she and her husband Darrell occupied at all material times. On July 24, 1980, First Federal Savings and Loan Association of Canton (First Federal) loaned Kaarups $50,000. Both Carol and Darrell signed the promissory note, and the note was secured by a mortgage on the home.
