This is an action brought by Alvin C. Bowen against the Chicago and Northwestern Railway Company. The amended declaration averred plaintiff was foreman of defendant’s car department at DeKalb, with the duty to inspect and repair the cars, and that it was defendant’s duty to furnish for his use suitable tools with which to inspect and repair cars; that while plaintiff was inspecting and repairing a certain car, the lever of a Joyce jack struck plaintiff on the side of the head and neck, causing partial deafness, great pain and a permanent injury; that the ratchet and notches of said jack had…
