Appellee instituted this suit to recover damages for personal injuries received while in appellant’s employ in hauling waste material gathered from the upper floor of appellant's mill. 1-Ie alleged that the method of doing the work was to gather and sack the material, and to then throw the sacks out of a window of the second story of the mill into a wagon placed against the building below to receive the sacks; that on the occasion in question, while in the wagon in a stooped position, and while engaged in adjusting some sacks which had been already cast down, one Walter…
