CAYTON, Chief Judge.

Before us are three appeals, in a confused situation arising from an attempted sale and resale of real estate. It began when a couple named Carpenter contracted in writing to sell their house to Slater for $22,500. This contract was negotiated through a salesman in the brokerage office of Wickersham. Simultaneously Berlin was interested in buying the same property and approached Peterson, another salesman of the Wickersham office. Peterson reported to Berlin that Slater had already contracted to buy the property, and Berlin desiring to acquire it from Slater, Peterson then…
