The positions occupied by the parties are the same here as in the court below, and they will be referred to as “plaintiff” and “defendant.”

The evidence shows that plaintiff was engaged in the sale of implements at Cordell, Oklahoma. The note and conditional sales contract sued on were executed for the purchase price of a Woods Brothers combine. Defendant made a down payment on the machine in the sum of $745.16, leaving a balance due in the sum of $1,163.73. Half of that amount was due and payable on June 2, 1949, and the balance on June 2, 1950. Defendant failed to make any of…
