— Judgment unanimously reversed, on the law, defendant’s motion to suppress granted, and defendant remanded to Onondaga County Court for further proceedings on the indictment. Memorandum: Defendant *938entered a plea of guilty to burglary in the third degree following denial by the suppression court of his motion to suppress physical evidence seized from him at the time of his apprehension (see, CPL 710.20 [1]). It was error to deny the motion.
