Plaintiffs, citizen-taxpayers, bring this proceeding for a declaratory judgment pursuant to CPLR 3001, and article 7A, § 123-b (1) of the State Finance Law, seeking a judgment declaring unconstitutional, sections 1, 2, 3 and 10 of Laws of 1990 (ch 220) (section 1 of said law now codified in Public Authorities Law, art 10-B, tit 4, §§ 3231-3249; section 2 now codified in Tax Law § 1148; section 3 now codified in State Finance Law § 92-r; section 10 not codified in the Consolidated Laws), which established, effective June 11, 1990, a New York Local…
