Relator Mike Joslin has brought this case under the qui tam provisions of the False Claims Act, 31 U.S.C. § 3729 et seq., alleging that Defendants violated the Act by submitting Medicare claims to which they were not entitled because of their alleged noncompliance with certain state licensing requirements for home health care facilities. The Government has declined to intervene. The Court previously denied various motions to dismiss and for summary judgment.
