This caus'e presents error from the district court of Pawnee county; the facts out of which it grew being substantially as follows: M. H. Stephens, the defendant in error, claims that he was employed by th'e town of Hallett, plaintiff in error, to run and operate the gas pump which pumped the water supply for the town, and that .plaintiff in error was negligent in failing to furnish him safe tools and appliances with which to work and negligent in failing to furnish him a safe place in which to perform his duties, and, as a result of such negligence on the part of the town of Hallett, in…
