After one of its employees was injured aboard ship in November, 1994, defendant Flagship Marine Services, Inc. d/b/a Sea Tow Services of Lee County (“Flagship”) sought to recover from its insurer, plaintiff Commercial Union Insurance Company — and wound up with a lawsuit instead.
