This is an action to recover on an insurance policy issued by defendant, which insured against, inter alia, theft of jewelry, antiques and antique jewelry at plaintiff’s principal place of business at 225 East 14th Street, New York, New York. Defendant appeals from an order which denied its motion, pursuant to CPLR 3211 (subd [a], par 7), to *280dismiss so much of the complaint by which plaintiff sought punitive damages and attorneys’ fees.
