Pending before the Court is the Federal Trade Commission’s (“FTC” or “Commission”) motion for preliminary injunction pursuant to Section 13(b) of the Federal Tr,ade Commission Act, 15 U.S.C. § 53(b). The Commission seeks to enjoin the acquisition by Swedish Match North America, Inc. (“Swedish Match”) of the loose leaf chewing tobacco business of National Tobacco Company, L.P. (“National”). This injunction is sought to maintain the status quo pending final disposition before the FTC of administrative proceedings to determine whether…
