MEMORANDUM AND ORDER

BECHTLE, District Judge.

Presently before the court is defendants’ motion to stay trial for declaratory judg ment and injunctive relief pending disposition of appeal, which this court will consider as a motion to stay the final hearing on those counts of plaintiff’s complaint that seek imposition of a permanent injunction and declaratory relief. In order to fully understand the court’s ruling on this motion, a review of the brief but important history of this action is necessary.
