Referee. In this action for an accounting, plaintiff seeks, in effect, to recover back an alleged overpayment made in 1929 to the executors of Dallas B. Pratt, who, prior to his death on October 9, 1929, was a partner in the private banking firm of Maitland, Coppell & Co. (hereinafter referred to as the old firm). Upon Pratt’s death, the surviving partners organized a new firm under the same name to continue the business.
