About 2:20 p. m. on August 16, 1928, Rudolph Min-ella, then a minor, was injured in an accident at a grade crossing of the defendant company. A work train pulled by an engine which was proceeding backwards crashed into a truck operated by him, seriously injuring Minella and destroying the truck. Suits for the injuries sustained by the minor plaintiff and by the truck were brought against the defendant and the cases were tried together. Defendant asked for binding instructions.
