On January 2, 2002, this Court issued a per curiam decision resolving a conflict between the Court of Appeals' opinions in this case, Ray-Hayes v. Heinamann, 743 N.E.2d 777 (Ind.Ct.App.2001) and Fort Wayne Int'l Airport v. Wilburn, 723 N.E.2d 967 (Ind.Ct.App.2000), trans. denied. The two opinions disagreed over whether a civil action is timely commenced if a plaintiff files a complaint within the applicable statute of limitations period, but does not tender the summons to the clerk within that period.
