Appeal from a judgment of the County Court of Fulton County (Giardino, J.), rendered February 4, 1998, upon a verdict convicting defendant of the crimes of driving while intoxicated (two counts) and criminal impersonation in the second degree.

Following a jury trial, defendant was convicted as charged on two felony counts of driving while intoxicated (see, Vehicle and Traffic Law § 1192 [2], [3]; § 1193 [1] [c]) and one count of criminal impersonation in the second degree.
