Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered August 10, 2000, upon a verdict convicting defendant of the crime of attempted murder in the second degree.

Following a jury trial, defendant was convicted of attempted murder in the second degree for an incident which occurred on August 10, 1999 on Bly Hollow Road in the Town of Berlin, Rensselaer County, during which a shotgun was fired from the roadside, striking Edgar Saunders in the hand and forearm as he drove his pickup truck.
