Affirming.

Appellant, JoeEeed, was indicted jointly with Eod Johnson for murder. He demanded, and was granted, a separate trial. Upon the call of his case the commonwealth answered ready, and the appellant appeared in person and by counsel. A jury was selected and sworn to try the case. The county attorney, representing the commonwealth, read the indictment to the jury in the presence of the accused and his counsel, and stated to' the jury, when he had finished reading it, that the defendant waived a formal arraignment and pleaded not' guilty.
