The facts as shown by the moving affidavits upon which the defendant applied for said relief are undisputed, and it appears *716therefrom that on December 4, 1920, the plaintiffs, copartners, brought an action against the defendant corporation George P. .Ide & Co., Inc., to recover the sum of $10,494.08, besides interest, upon two causes of action set forth in the complaint, the first cause of action being for goods sold and delivered of the value of the amount aforesaid, and the second cause of action being upon an account stated for a balance in said sum of $10,494.08.
