The appellants were convicted of the crime of murder, and sentenced to death.

The evidence is not before us, the appeal being on the judgment roll.

Counsel for appellants contend that certain evidence was improperly admitted, and claim that we can consider the action of the court in overruling their objection thereto, in the absence of the evidence, because it appears from the instructions of the court that the jury were thereby directed not to consider the same.
