HALL, Justice.
This lawsuit originated over the terms of a written contract dated February 12, 1941 (retroactive to January 1, 1941), to expire December 31, 1945, by and between the City of Fort Worth, Tarrant County, Texas, as lessor, and George T. Smith of Tar-rant County, Texas, as lessee; covering two tracts of land located on and adjacent to a portion, of Lake Worth. Only Tract One is involved in this ‘ lawsuit, which is situated at a point where the Jacksboro Highway intersects the shore line of Lake Worth.
