CLAYTON, District Judge.

The plaintiff filed on March 23, 1922, praecipe in the circuit court of Dade county, Fla., in this action for summons directed to the defendant. Personal service was made March 23, 1922, in accordance with the Florida- statute. On the same day the plaintiff filed his declaration, claiming $11,000,000 damages. The first six counts thereof are the common counts.
