Appeal from a judgment of the County Court of Schenectady County (Harrigan, J.), rendered December 18, 1987, upon a verdict convicting defendant of the crime of criminally negligent homicide.
On September 14, 1986 Philip Borutta was walking alone on Paige Street in the City of Schenectady, Schenectady County, when he was confronted and attacked by defendant without provocation. As a result of the punches to the face, the victim was knocked down, struck his head on the pavement and was rendered unconscious.
