THE COURT.

This is an action in conversion instituted by John W. Mears, owner and holder of 20,000 shares in I.X.L. Mining Company, a Philippine Corporation, herein further called the Company, against Crocker First National Bank of San Francisco, further called Crocker Bank, a transfer agent for stock of the company, because of its alleged refusal to transfer said 20,000 shares into block shares of 20 shares each.
